In addition to standard transfers, our firm offers expert assistance in the drafting, registration, and endorsement of real and personal rights over immovable property, include but not limited to:

  • Usufruct, Usus, and Habitatio: Personal servitudes granting limited use or enjoyment of property without ownership. Our firm ensures these rights are properly created, executed by a notary where applicable and registered against the title deed.
  • Fideicommissum: A conditional right in terms of which a property is transferred to one party, with a legal obligation to pass it on to another at a later stage. We assist in both the creation and subsequent transfer or endorsement of such interests.
  • Right of Way and Servitudes: Registration of personal or praedial servitudes such as rights of access, use of pipelines, or other burdens over land.
  • Long-Term Leases and Real Rights of Extension (Sectional Title): Registration of long-term lease agreements and exclusive use or extension rights in sectional title schemes.

What is an
Endorsement?

An endorsement is an official legal update to your title deed, without changing ownership, ensuring the public record reflects your current legal status. 

  • Marital status updates (e.g. Section 45bis Endorsements);
  • Deceased Estates and Survivorship Transfers (e.g. Section 45 and Section 45bis(1A) Endorsements);
  • Amendments on title and bond deeds relating name or identity/ registration number changes, for individuals, trusts, or juristic entities. 
  • Trustee or Director Changes for titleholders acting in a representative capacity;
  • Conversion of holding structures, such as from shareblock or company ownership to individual title;
  • Endorsement of Trust Property, where the title deed must reflect that ownership vests in trustees.
