Protection

Orders

Your safety. Your rights. Your peace of mind.

At A De Bruyn Attorneys, we assist individuals facing domestic violence, harassment, stalking or intimidation with urgent, court-recognised legal protection. A Protection Order isn’t just a document, it’s a court order with immediate consequences for any breach and we ensure it’s drafted, enforced and respected.

What is a Protection Order?

A Protection Order is a court order issued under the Domestic Violence Act 116 of 1998, which restrains an abuser from continuing harmful conduct. It can prohibit direct or indirect contact, remove the abuser from a shared home, and in urgent cases, provide immediate interim protection.

Abuse covered under the Act includes:

  • Physical or sexual abuse
  • Emotional, verbal or psychological abuse
  • Harassment or stalking
  • Digital abuse (via WhatsApp, social media, tracking apps)
  • Financial or economic abuse (see below)

Yes, Financial Abuse is Legally Recognised

Legislation now clearly recognises economic or financial abuse as domestic violence. You can apply for a Protection Order if someone is:

  • Withholding money or resources you’re entitled to
  • Preventing you from working or earning an income
  • Controlling or misusing joint finances or assets
  • Sabotaging your ability to meet basic needs

We assist by gathering proof of this conduct (e.g. bank records, text messages, income denials) and incorporating it into your sworn affidavit for court.

How We Help – Step by Step

You don’t have to face this process alone. Our firm provides direct, hands-on assistance through each phase of the Protection Order process:

Legal Consultation

We assess your situation confidentially, advise on your rights, and determine the best course of legal action , whether urgent or planned.

Drafting the Application

We draft and file the necessary Form 2 Application, including a detailed affidavit outlining the abuse. We attach supporting evidence (financial records, messages, photographs, etc.) and identify urgent risks for interim relief.

Emergency Protection (Interim Order)

Where necessary, we request that the court grant same-day emergency protection. This can include immediate restraints and orders for temporary maintenance or asset access.

Representation at Court

We appear in court on your behalf for the return date, present your case, and cross-examine the respondent if needed. You don’t have to speak or face the abuser alone.

Final Protection Order

We assist with finalising and serving the court order, and ensure its terms are enforceable – including consequences for violations.

What Protection Can Include

A Protection Order contain provisions such as:

  • No contact (direct or indirect)
  • Prohibition from entering the complainant’s home or workplace
  • Return of specific property (e.g. car, bank cards, children’s belongings)
  • Orders to cease economic control or provide financial support
  • Supervised contact with children or temporary suspension of contact
